1. Acceptance of Terms

Welcome to Blue Green Intelligence ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our maritime API services, including our Weather API, Vessel Routing API, and related dashboard services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Description of Services

Blue Green Intelligence provides maritime technology APIs designed specifically for maritime professionals and applications:

• Weather API: Marine weather data including waves, currents, temperature, and salinity
• Vessel Routing API: Intelligent vessel routing considering draft, ECA zones, and waypoints
• Future APIs: Weather Tiles API and Weather Routing API (in development)
• Dashboard Services: User management, usage tracking, and subscription management

3. User Accounts and Registration

3.1 Account Creation

To use our Services, you must create an account through our AWS Cognito authentication system. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and API tokens. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. API Usage and Restrictions

4.1 Permitted Use

You may use our APIs for legitimate maritime applications, including but not limited to:

• Vessel navigation and route planning
• Weather monitoring and forecasting applications
• Maritime safety and operational systems
• Research and development in maritime technology

4.2 Prohibited Use

You agree not to:

• Use the APIs for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble our Services
• Share, sell, or redistribute your API tokens
• Exceed your subscription quota limits
• Use the Services to harm, threaten, or harass others
• Interfere with or disrupt the Services or servers
• Use automated systems to access the Services beyond normal usage patterns

4.3 Rate Limits and Quotas

Your use of the APIs is subject to rate limits and quotas based on your subscription plan. Exceeding these limits may result in temporary suspension of access or additional charges as outlined in your plan.

5. Subscription Plans and Billing

5.1 Plan Types

We offer various subscription plans including free and paid tiers. Each plan has specific quota limits and features as described on our website.

5.2 Billing

Paid subscriptions are billed monthly in advance. You agree to pay all charges associated with your account. We reserve the right to change our pricing with 30 days' notice.

5.3 Overage Charges

If you exceed your plan's quota limits, additional charges may apply as specified in your subscription plan. Overage charges will be billed monthly.

5.4 Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period. No refunds are provided for partial months.

6. Intellectual Property Rights

6.1 Our Rights

The Services, including all software, APIs, data, and content, are owned by Blue Green Intelligence and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services according to these Terms.

6.2 Your Rights

You retain ownership of any applications or content you create using our APIs. However, you grant us the right to use aggregated, anonymized data for service improvement purposes.

7. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We may collect and analyze usage data to improve our Services, but we will not share your personal information with third parties except as described in our Privacy Policy.

8. Service Availability and Support

8.1 Service Level

While we strive to provide reliable service, we do not guarantee 100% uptime. We will make commercially reasonable efforts to maintain service availability.

8.2 Support

We provide support through email and our dashboard system. Support response times vary based on your subscription plan and the nature of your inquiry.

8.3 Maintenance

We may perform scheduled maintenance that temporarily affects service availability. We will provide advance notice when possible.

9. Disclaimers and Limitations of Liability

9.1 Service Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Data Accuracy and Navigation Disclaimer

While we strive to provide accurate maritime data, we do not guarantee the accuracy, completeness, or timeliness of any data provided through our APIs. Users should verify critical information through multiple sources.

IMPORTANT: Our services are provided on a GUIDANCE BASIS ONLY. Under no circumstances should our data be the sole basis for navigation decisions. All navigation decisions must always be based on the Master's professional judgment and company procedures. The Master and crew remain fully responsible for vessel safety and compliance with maritime regulations.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUE GREEN INTELLIGENCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES.

9.4 Maximum Liability

Our total liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Blue Green Intelligence and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Services or violation of these Terms.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion features in your dashboard.

11.2 Termination by Us

We may terminate or suspend your account immediately if you violate these Terms or for any other reason with or without notice.

11.3 Effect of Termination

Upon termination, your right to use the Services will cease immediately. We may delete your account data, though we may retain certain information as required by law or for legitimate business purposes.

12. Changes to Terms

We may modify these Terms at any time by posting the updated Terms on our website. We will notify you of material changes via email or through our Services. Your continued use of the Services after changes become effective constitutes acceptance of the new Terms.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 2015.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blue Green Intelligence regarding the Services.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
